This website (the "Site") offers information, products, and services related to real estate (the "Services") that Susan Gorden Ryan, REALTOR® (Jack Conway) provides. We operate this website and may use third-party contractors to support the delivery of the Services and the Site ("Service Providers").

If you are a visitor to this Site, this Privacy Policy applies to you and describes the policies and practices regarding the collection, use, and disclosure of your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us in providing the Services solely in their capacities as service providers and data processors.

This Privacy Policy does not apply to any websites, applications, or other online services that do not link to this Policy, including other services provided by us or by our Service Providers. Personal information we collect

Information you provide to us

Contact information that you provide, such as your first and last name, email address, home address, and phone number; feedback or correspondence, such as information you provide when you contact us with questions, feedback, or other correspondence; marketing information, such as your preferences and consents for receiving communications about our activities, events, and publications, and details about how you engage with such communications; and other information which you may provide voluntarily or that is necessary in connection with your interactions with us through the Site or Services.

Information we obtain from third parties

Social media information. We maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, and YouTube. When you visit or interact with these pages, the platform providers' privacy policies will apply to your interactions and their collection, use, and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

Data enrichment sources. We may obtain additional information about you from third-party data providers and publicly available sources, including property records, other public records, contact information, and professional or business information.

We do not use enrichment data, and do not permit any third party to use enrichment data obtained through us, to make or assist in making any decision regarding your eligibility for housing, credit, insurance, employment, or any other benefit or transaction for which a consumer report would be required under the federal Fair Credit Reporting Act.

Other sources. We may obtain your personal information from other third parties, such as third-party analytics services, marketing partners, publicly available sources, and data providers.

CRM and communication data

If you communicate with us via email, text message, or other electronic means, or if we use customer relationship management ("CRM") tools to manage our interactions with you, we may collect and process email message content, headers, metadata, and attachments; text message content and metadata; communication timestamps, read receipts, and delivery status; contact information and communication history; and notes and records relating to our interactions with you.

Our CRM services may synchronize with email accounts to facilitate communication management. When email synchronization is enabled, information from emails exchanged with you may be processed and stored, including email content, sender and recipient information, timestamps, and attachments. This data is used to provide better service, maintain accurate records, and facilitate follow-up communications.

Automatic data collection

We and our Service Providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications, and other online services. That includes device data such as your operating system type and version, manufacturer and model, browser type, screen resolution, device type, IP address, unique identifiers, language settings, mobile carrier, and general location such as city or state; and online activity data such as pages you viewed, how long you spent on a page, browsing history, navigation paths, access times, and whether you have opened our marketing emails or clicked links within them.

Where these tools are enabled, we use cookies (text files that websites store on a visitor's device to identify the browser or store settings), local storage technologies (such as HTML5, which provide cookie-equivalent functionality for larger amounts of data), and web beacons (also known as pixel tags or clear GIFs, used to show that a webpage or email was accessed or opened, or that certain content was viewed or clicked).

Chat and messaging features

If the Site offers live chat, an automated chat assistant, or a similar messaging feature, your conversations may be recorded, stored, and processed by us and by the Service Providers who operate that feature on our behalf. Please do not submit sensitive personal information through a chat feature.

How we use your personal information

We may use your personal information for the following purposes.

To provide and operate our Services and our Site. We use your information to provide, operate, and improve our Services and Site; to communicate with you about our Services and business, including announcements, updates, security alerts, and support and administrative messages; and to provide support and respond to requests, questions, and feedback.

To manage our relationship with you. We use CRM tools and services to maintain records of our communications, track your preferences and interests, and provide personalized service. This may include analyzing your interactions with us to better understand your needs and preferences.

To send you follow-up communications. If you have opted into receiving follow-up communications, we or our Service Providers may from time to time send you follow-up communications as permitted by law, including by phone, email, and SMS text message, some of which may use artificial or prerecorded voices. You may opt out as set out under "Your privacy choices" below.

To send you marketing and promotional communications. If you have opted in to receive marketing and promotional communications, we or our Service Providers may from time to time send you direct marketing communications as permitted by law, including by phone, email, and SMS text message, some of which may use artificial or prerecorded voices. You may opt out as set out under "Your privacy choices" below.

To comply with law. We and our Service Providers use your information where we believe it is necessary or appropriate to meet applicable laws, lawful requests, and legal process. That includes a response to a subpoena or to a request from a government authority.

For compliance, fraud prevention, and safety. To protect our, your, or others' rights, privacy, safety, or property, including by making and defending legal claims; to enforce the terms and conditions that govern our Services; and to protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or illegal activity.

To create anonymous data. We may create anonymous data from your personal information and that of other individuals whose personal information we collect, by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve our Services, conduct research, and promote our business.

Use of artificial intelligence

We use artificial intelligence ("AI") and machine learning technologies to provide and improve our Services. This section describes how AI is used in connection with the Site and Services.

AI-generated content

We may use AI technologies to generate, assist with, or enhance content displayed on the Site or provided through our Services, including property descriptions and listing information; blog posts, articles, and other written content; social media posts and marketing materials; email communications and newsletters; and advertising copy and promotional content.

AI-generated content is created using large language models and other machine learning systems. While we review AI-generated content for accuracy and appropriateness, such content may contain errors, omissions, or inaccuracies. You should not rely solely on AI-generated content for important decisions, including real estate transactions, without independent verification.

AI-assisted communications

We may use AI to assist with communications, including drafting and suggesting responses to inquiries, analyzing communication patterns to improve service, providing automated responses to common questions, and prioritizing and categorizing incoming communications.

When AI assists with communications, a person may review and approve messages before they are sent, though some automated responses may be sent without individual human review.

AI-based analysis and recommendations

We may use AI to analyze data and provide recommendations, including identifying potential opportunities based on your stated preferences and behavior, suggesting properties that may match your criteria, analyzing market trends and conditions, and optimizing the timing and content of communications.

These AI-based analyses and recommendations are provided for informational purposes and should not be considered professional advice. Important decisions should be made in consultation with qualified professionals. We do not use AI to make, and AI does not make, any decision that produces a legal or similarly significant effect concerning you.

Your choices regarding AI

You may ask us whether AI was used to generate specific content provided to you, ask that a person review any significant determination made with AI assistance, and provide feedback on AI-generated content or recommendations. How we share your personal information

We do not "sell" any personal information as that term is defined under applicable laws, but we may share your personal information as described below and as described elsewhere in this Privacy Policy. We may share your personal information with:

Our internal team, partners, and affiliates, including our contractors, partners, and affiliates, to facilitate your interactions with us.

Our Service Providers, meaning companies and individuals that provide services on our behalf or help us provide the Services, the Site, or our business. That includes hosting, information technology, CRM services, email delivery, text message and other messaging delivery, AI and machine learning services, advertising, and website analytics services. The Service Providers behind this Site are GoHighLevel, which receives and stores inquiries submitted through the forms on this Site; Vercel, which hosts the Site; and Anthropic, which powers any AI assistant feature offered here. Each of them processes personal information on our behalf and under our instructions.

Professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us or our Service Providers.

For compliance, fraud prevention, and safety, we or our Service Providers may share your personal information for the purposes described above.

Business transfers. We or our Service Providers may sell, transfer, or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction or potential business transaction such as a corporate divestiture, merger, consolidation, acquisition, reorganization, or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Other than as set out here, data will not be shared with third parties for marketing or promotional purposes. We will never disclose any personal information such as phone numbers and SMS consent with any third parties for marketing purposes, and we do not include telephone numbers in any list uploaded to an advertising platform.

Advertising and tracking technologies

We may use advertising and tracking technologies to deliver relevant advertising and measure the effectiveness of our marketing efforts. Where none is enabled, no third-party advertising or analytics script loads on this Site.

Third-party advertising platforms

Where these are enabled, we may share certain information with third-party advertising platforms, including Meta (Facebook and Instagram), Google, and other advertising networks, in order to deliver advertisements to you based on your interests and interactions with our Site; measure the effectiveness of our advertising campaigns; create audiences of similar users for advertising purposes ("lookalike audiences"); and track conversions and attribute advertising performance.

When you interact with our Site, third-party advertising platforms may collect information through cookies, pixels, and similar technologies. This information may include your device identifiers, browsing behavior, and interactions with our advertisements. We do not include your name, email address, phone number, or home address in any advertising event.

Tracking pixels and conversion events

Where a tracking pixel is enabled on this Site, it may be used to record when you view or interact with our content, measure the effectiveness of our email campaigns, attribute conversions to specific advertising campaigns, and analyze how the Site is used. These technologies may transmit information to third-party platforms, including the pages you visit, actions you take on our Site, and information about your device.

Interest-based advertising

We may participate in interest-based advertising, which means that you may see our advertisements on third-party websites and platforms based on your browsing behavior and inferred interests. Under some state privacy laws this activity is treated as "sharing" or as "targeted advertising", and you have the right to opt out of it as described below.

You have the following choices regarding our collection and use of your personal information.

Opting out of targeted advertising, sale, and sharing

You may opt out of our sharing of personal information for targeted advertising at any time by contacting us using the details under "How to contact us" below. We honor an opt-out for the browser and device on which it is submitted, and, where we can reasonably associate the request with you, across your other interactions with us.

Opt-out preference signals and Global Privacy Control

Your browser or a browser extension may be able to send an opt-out preference signal, such as Global Privacy Control ("GPC"). We treat a GPC signal received from your browser as a valid request to opt out of the sale or sharing of personal information associated with that browser and device.

Do Not Track

Some internet browsers may be configured to send "Do Not Track" signals to the online services that you visit. Online tracking opt-out

There are a number of ways to opt out of having your online activity and device data collected through our Services. You can block cookies in your browser, since most browsers let you remove or reject cookies, including cookies used for interest-based advertising; to do this, follow the instructions in your browser settings, and for more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit allaboutcookies.org. You can block advertising ID use in your mobile settings, since your mobile device settings may provide functionality to limit use of the advertising ID associated with your device for interest-based advertising. You can also use privacy plug-ins or browsers, such as Brave, Privacy Badger, DuckDuckGo, Ghostery, or uBlock Origin.

Platform opt-outs

The following advertising partners offer opt-out features that let you opt out of the use of your information for interest-based advertising: Google and Facebook.

Advertising industry opt-out tools

You can also use these opt-out options to limit use of your information for interest-based advertising by participating companies: the Digital Advertising Alliance and the Network Advertising Initiative. Because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

SMS and email opt-out

To opt out of receiving SMS communications, reply STOP to any SMS communication sent to you. You may unsubscribe from email updates sent by us at any time by following the unsubscribe link in the email.

Your privacy rights

You have the right to submit requests about your personal information, depending on your location and the nature of your interactions with the Site and our Services. These rights may include information about how we have collected and used your personal information, which we have made available to you without your having to request it by including it in this Privacy Policy; access to a copy of the personal information that we have collected about you, which where applicable we will provide in a portable, machine-readable, readily usable format; correction of personal information that is inaccurate or out of date; deletion of personal information that we no longer need to provide our services or for other lawful purposes; and additional rights, such as to object to and request that we restrict our use of your personal information, and where applicable to withdraw your consent.

Data retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements, and to provide you with the Services.

The retention period depends on the context and our relationship with you. Contact information and communication records are generally retained for the duration of our relationship with you and for a reasonable period afterwards, to allow for follow-up communications and to comply with legal requirements. CRM data, including email synchronization data, is retained for as long as you maintain an active relationship with us, unless longer retention is required by law. Transactional records may be retained to comply with legal and regulatory requirements. Marketing preferences are retained until you update them or opt out.

When personal information is no longer necessary for the purposes for which it was collected, we will securely delete or anonymize it. In some cases we may retain certain information in anonymized or aggregated form for analytical purposes.

How we handle requests to delete

When we grant a request to delete your personal information, we delete it from our systems and direct our Service Providers to do the same. We retain a record that you made the request, together with the limited identifying information needed to recognize you, so that we can continue to honor your request and can demonstrate that we honored it. We do not use that record for any other purpose, and it is not used to contact you or to market to you. If you would prefer that we retain nothing at all, you may tell us so when you make your request, and we will remove that record as well. Copies that remain in backup or disaster-recovery systems are overwritten in the ordinary course of those systems' rotation.

Third-party services, security, and children

Third-party services

The Site and Services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or a representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions.

Security

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect, at a level of security appropriate to the risk of processing your personal data. We follow generally accepted industry standards to protect the personal data submitted to us, both during transmission and in storage. However, no method of transmission over the internet or method of electronic storage is completely secure. While we strive to use commercially acceptable means to protect personal data, we cannot guarantee its absolute security.

Children

The Services are not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Services from a child under 18 without the consent of the child's parent or guardian as required by law, we will delete it. We do not knowingly sell or share the personal information of any consumer under 16 years of age.

SMS text messaging terms

Use of SMS text messaging. We use SMS text messaging to confirm appointments, send reminders, and notify clients of schedule updates or important changes.

Unsubscribing. You can cancel the SMS service at any time. Text STOP. After you send the message STOP to us, we will send you a message to confirm that you have been unsubscribed, and after that you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS messages to you again.

Assistance. If you are experiencing issues with the messaging program, reply with the keyword HELP for more assistance, or get help directly at susan@susangordenryan.com.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Frequency and data rates. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Notice and additional rights for California residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), permits you to request information, no more than once per calendar year, regarding the disclosure of your personal data by us to third parties, including for the third parties' direct marketing purposes. California residents also have the following rights with respect to personal data we may have collected about them.

Categories of personal information collected

In the preceding 12 months we may have collected the following categories of personal information: identifiers such as name, email address, phone number, and IP address; personal information described in California Civil Code section 1798.80(e), such as name, address, and telephone number; characteristics of protected classifications under California or federal law; commercial information such as property preferences and transaction history; internet or electronic network activity such as browsing history and interactions with our Site; geolocation data such as city and state derived from IP address; audio, electronic, or visual information such as the contents of email, text messages, and chat sessions; professional or employment-related information if provided; inferences drawn from the above; and sensitive personal information only if voluntarily provided, such as account credentials.

We collect these categories from you directly, from your device and browser, from our Service Providers, from social media platforms, and from third-party data providers and publicly available sources. We collect and use them for the business and commercial purposes described under "How we use your personal information". We disclose them for the business purposes and to the categories of recipients described under "How we share your personal information".

Requests to know

You have the right to request that we disclose to you the categories of personal data we have collected about you; the categories of personal data about you that we have sold or disclosed for a business purpose; the categories of sources from which we have collected personal data about you; the business or commercial purposes for selling or collecting personal data about you; the categories of personal data sold or shared about you, together with the categories of third parties to whom it was sold; the specific pieces of personal data collected; and how long your personal data is retained. You may submit a request to know using the contact details below. Our response may be delivered electronically or by mail. We are not required to respond to requests to know more than twice in a 12-month period.

Requests to delete or correct

You have the right to request that we delete any personal data about you that we have collected, or correct personal data that we hold about you that is inaccurate. Upon receiving a verified request to delete personal data, we will do so unless otherwise authorized by law. Where we grant a request to delete, we handle it as described under "Data retention".

Authorized agents

You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an agent that has been provided a power of attorney pursuant to Probate Code sections 4000 to 4465 may submit a request on your behalf.

How to submit a request, and how we respond

Upon receipt of a request, we may ask you for additional information to verify your identity. Any additional information you provide will be used only to verify your identity and not for any other purpose. We will acknowledge receipt of your request within ten business days. Subject to our ability to verify your identity, we will respond to your request within 45 calendar days of receipt. If we require more time, up to 90 days, we will inform you of the reason and the extension period in writing. Any disclosures we provide will cover only the 12-month period preceding receipt of the verifiable consumer request. Our response will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded, and if we determine that a request warrants a fee we will tell you why and provide a cost estimate before completing it.

The right to non-discrimination

You have the right not to be discriminated against for exercising the California privacy rights described above.

Selling and sharing of personal data

California law places certain obligations on businesses that "sell" personal data to third parties or "share" personal data with third parties for "cross-context behavioral advertising" as those terms are defined under the CCPA. We may "share" certain personal information, such as device identifiers and browsing activity, with advertising partners for cross-context behavioral advertising purposes as described under "Advertising and tracking technologies". You have the right to opt out of this sharing. To opt out, you may transmit a Global Privacy Control signal from your browser, or contact us using the details below. We do not knowingly sell or share the personal information of consumers under 16 years of age. We do not "sell" personal data as that term is defined under the CCPA.

Sensitive personal data

Some personal data may be considered sensitive personal information under certain privacy laws, including the CCPA. Sensitive personal information may include, for example, a government-issued identification number, information relating to a person's race or ethnic origin, political opinions or religious beliefs, physical or mental health or condition, sexual orientation, or trade union membership. It may include information about an individual's criminal offenses or convictions, as well as any other information deemed sensitive under applicable data protection laws.

The CCPA provides consumers with the right to limit the use of their sensitive personal information to certain business purposes. We do not request sensitive personal information in connection with the use of the Site, except for account credentials which are used only to provide and secure your account. We do not use or disclose sensitive personal information for any purpose that would trigger the right to limit, and we therefore do not offer a separate limitation mechanism.

Additional rights for residents of other US states

If you are a resident of a state with a comprehensive consumer privacy law, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, or Rhode Island, you may have the right, subject to the terms of your state's law, to:

  • Confirm whether we are processing your personal information, and access that information.
  • Obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
  • Correct inaccuracies in your personal information.
  • Delete personal information we have collected about you. Where we grant a request to delete, we handle it as described under "Data retention".
  • Opt out of the processing of your personal information for targeted advertising, for sale, or for profiling in furtherance of decisions that produce legal or similarly significant effects. We do not engage in such profiling.
  • Obtain a list of the third parties to whom we have disclosed your personal information, where your state law provides that right.

To exercise any of these rights, contact us using the details below, or, to opt out of targeted advertising, transmit a Global Privacy Control signal from your browser. We honor recognized universal opt-out mechanisms where required by your state's law.

Appeals

If we decline to act on your request, you may appeal our decision by replying to our response or by contacting us at susan@susangordenryan.com with the subject line "Privacy Request Appeal". We will respond to your appeal in writing within the period required by your state's law, generally 45 or 60 days, and will explain the reasons for our decision. If we deny your appeal, you may contact your state Attorney General to submit a complaint.

Residents of the European Economic Area, the UK, and Switzerland

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the following applies to our processing of your personal information.

You have the right to request access to your personal information, rectification of inaccurate information, erasure, restriction of processing, and portability; to object to processing carried out on the basis of legitimate interests, including direct marketing; and to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal. International transfers. We and our Service Providers are located in the United States, and your personal information will be transferred to and processed in the United States and other countries that may not provide the same level of data protection as your home jurisdiction. Where we transfer personal information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses together with the UK International Data Transfer Addendum where applicable. Supervisory authority. You have the right to lodge a complaint with the data protection supervisory authority in your country of residence, place of work, or the place of the alleged infringement. In the United Kingdom, that authority is the Information Commissioner's Office.
